TO QUALIFY FOR A BROKER/ SALESPERSON LICENSE

AN APPLICANT MUST

  • be of good moral character,
  • be a US citizen or legal resident,
  • be of legal age,
  • have a high school education or equivalency
  • and must successfully complete 150 hours of pre-licensure education.

Applicants must first complete a 90-hour general real estate course, and then two 30-hour courses on Agency/Ethics and Office Management and related topics.

                THE NEW JERSEY REAL ESTATE COMMISSION HAS CONCLUDED

                       THAT AN APPLICANT FOR BROKER / SALESPERSON MAY                           COMPLETE THE 3 COURSE LICENSURE EDUCATION IN ANY ORDER.

 

In addition, applicants must have been continually licensed and employed on a full-time basis as a New Jersey real estate salesperson for the three years immediately preceding application.


After completion of all three courses applicants must submit to the Education Qualification Section of the Commission their completed school certificate and a completed Experience Report For Broker Applicant form.


Following review and approval, the applicant will be mailed a Certificate of Examination Eligibility, which may be used to make a reservation to take the Broker license examination.


An applicant must pass the broker license examination and apply for and request the issuance of a license as a broker or broker-salesperson not later than one year after their successful completion of the broker pre-licensure education requirements.

The Broker / Salesperson program requires that students complete 30 hours of pre-licensing course curriculum in Brokers’ ETHICS AND AGENCY LAW, with the categories and hours as prescribed by New Jersey Statute and Rules in effect on the course completion date.

  • Fiduciary duties owed by agents to their principals
  • Disclosed and undisclosed dual agency
  • Conflict of interest and self - dealing
  • Risks and benefits of sub - agency to the principal and agent
  • Restrictions on and disclosure requirements regarding acting for more than one party to a transaction
  • Disclosure requirements to non - principals
  • Issues raised by licensees involved in transactions as non - agents
  • Obligations to properly qualify or pre - qualify prospective purchasers

30 hours

The Broker / Salesperson program requires that students complete 30 hours of pre-licensing course curriculum in Brokers’ OFFICE MANAGEMENT, with the categories and hours as prescribed by New Jersey Statute and Rules in effect on the course completion date.

  • Office management requirements imposed upon supervising brokers of main and branch offices
  • Record / Keeping requirements - escrow account records
  • Importance of adequate supervision and training of other licensees to assure compliance with license law
  • Instruction on proper qualification and pre-qualification techniques
  • Statutory and rule requirements pertaining to contracts, leases, listing agreements and broker advertising
  • Closings
  • Environmental concerns
  • Instruction on licensure requirements and procedures applicable to license applications, transfers, changes of broker address, branch offices, etc., and office closing requirements
